I am directed by Mr. Secretary Henderson to
refer to your letter No. 82755/31 of the 18th May on the
subject of the amendments to the draft of the proposed
Hongkong-China Customs Agreement.
2. I am to suggest that in the list of amendments
enclosed in your letter under reference "Line 1;" should
be inserted after Article 6, Article 8, Article 9,
Article 10 and Article 11, and in the draft despatch the
first sentence of paragraph 3 (1) should read "As the
"agreement will create international obligations between
the Government of China and the Government of the United
"Kingdom in respect of Hongkong it must take the form of an
"intergovernmental agreement and consequently be signed
"etc. etc."
Subject to these amendments Mr. Henderson
concurs in the terms of the draft despatch and enclosure
which Lord Passfield proposes to address to the Governor
of Hongkong.
